What is a Qualified Medical Examiner (QME)?

A Qualified Medical Examiner (QME) is a physician certified by the California Department of Workers’ Compensation (DWC), Medical Unit to perform independent medical evaluations for injured workers involved in workers’ compensation claims.

QMEs play a critical role when there is a dispute or question regarding a work-related injury. Their job is to provide an objective medical-legal evaluation and issue a formal report that helps determine issues such as:

  • Whether an injury or condition is work-related
  • The extent and severity of the injury
  • Appropriate treatment recommendations
  • Temporary or permanent disability status
  • Work restrictions or ability to return to work
  • Future medical care needs

The QME’s findings are used by claims administrators, attorneys, judges, and the Workers’ Compensation Appeals Board to help resolve disputes fairly and efficiently.

Key Differences Between IME and QME

While both IME and QME involve a doctor reviewing a patient’s injuries, a QME is a state-certified, neutral evaluator used specifically for workers’ compensation disputes, whereas an IME is generally a broader, insurer-selected evaluation. Some additional differences between IMEs and QMEs include:

Regulation & Scope:

QMEs are certified by the California Division of Workers’ Compensation (DWC) to resolve disputes. IMEs are utilized across various insurance contexts (auto accidents, disability, liability) and are not restricted by specific state panel regulations.

Certification Process:

To become a QME, physicians (MDs, DOs, DCs, Dentists, Optometrists, Podiatrists, Psychologists, or Acupuncturists) must pass a competency exam administered by the DWC Medical Unit. Any physician can perform an IME, although they are typically board-certified.

Neutrality:

A QME is considered a neutral examiner whose role is to provide a neutral, binding report on a disputed issue. An IME is often arranged by an employer or insurance company, and while it is supposed to be objective, it is frequently seen as favorable to the insurer.

Usage:

QMEs are used to resolve specific disputes, such as impairment ratings, after a conflict arises in California worker’s comp. IMEs are generally used to get an independent opinion to confirm or challenge a treating physician’s assessment.

Legal Standing:

QME reports carry high evidentiary value in California workers’ compensation court, often serving as the deciding document, Spectrum Medical Evaluators. IME reports are used to evaluate, dispute, or confirm treatment plans but may carry less weight depending on the specific jurisdiction and judge.
